To date, the City Council has neither approved <br />nor denied the application, despite the requirement contained <br />in Section 170.019(B) (5) of the City Code that such requests <br />be acted upon within 45 days of the public hearing. Mr. Bulen <br />has not waived this time limit, and in fact has manifested his <br />refusal to consent to an extension of this time limit. <br /> <br />I will be ~ppearing at the regular City Council meeting to be <br />held this evening, November 25, representing Mr. Bulen. However, <br />neither my appearance nor any comments which may be made by <br />myself should be interpreted as any waiver by Mr. Bulen of <br />any rights he may have to claim a granting of his zoning request <br />by default, and Mr. Bulen specifically reserves his legal <br />rights relative to such claims. <br /> <br />I would request that this letter be made a part of the City file <br />on the rezoning request, and that my comments be made a part of <br />the minutes of the meeting. <br /> <br />Respectfu. lly,~ /~ .. <br /> <br />cc: Wes Bulen <br /> <br />I <br /> <br /> <br />
