I I I I I I Mr. Lehn added that there have been complaints made about the dogs when he has had them out of town. He feels that he is being harassed. Chief of Police Auspos stated that he had observed teh dogs on two differnt n~.ghts and they were not barking, but in answer to a 7:00 A.M. call this morning, he did find them barking. Anyone wishing to carry this matter fur- ther would have to keep a log of dates and times the dogs were barking ex- cessively. Mayor Gamec stated he had checked the police records and found all complaints were by one person. He had checked with neighbors and they say the dogs bark but that it was no real nuisance. Mr. Lehn informed the Council that he is now muzzling the dogs. Council stated that if a conditional use permit is ussed, it should be on the condition that the dogs are muzzled when they are unattended or when- ever necessary. Mr. Lehn stated he was agreeable to this condition. Councilmenber Van Wagner stated that she recommends deleting Item #2 re- garding a veterinarian inspection. ,I I I I I I I I I I Councilmember Sorteberg stated that he recommends deleting Item #3 regarding keeping the dogs indoors at night and replacing it with wording to the effect that the dogs will be muzzled when they are unattended or whatever is necessary to stop habitual barking. Motion by Councilmember Van Wagner and seconded by Councilmember Sorteberg to approve the conditional use permit agreement, deleting Item #2 and #3 and adding the condition that the dogs be muzzled whenever necessary, further that Mr. Lehn be allowed to maintain three (3) dogs in a private kennel at his residence of 17540 Nowthen Blvd. N.W. It is further directed that the Mayor and City Administrator be authorized to sign said agreement.. Motion carried. Voting yes Mayor Gamec, Councilmembers Van Wagner, Sorteberg, Reimann and Cox. Voting no None. Case #4 - Mr. Julian Stephen Schmidt's Request to Rezone his property from R-1 to B-1 for a Shopping Center: A presentation of the proposed shopping center was made to the Council by Mr. Robert Muller. Mayor Gamec made note of a letter from Mr. Julian Stephen Schmidt to the Ramsey City Council regarding the rezoning of the properety at the inter- section of Highway #47 and 167th Avenue N.W. Mayor Gamec also stated that he had searched past minutes and couldn't find where the Coon Rapids Clinic had put in a request for rezoning. The busi- ness is not doing well in Ramsey's present B-1 area and we now have to decide to keep pushing this area or replan. In talking with developers of the Southeast corner of Ramsey, he had found they ar~ now looking at multiple dwellings and retail business. C/October 27, 1981.. Page 10
