I I I I I I I I I I I 1) 2) 3) PROPOSED FINDINGS OF FACT RE: WILLIAM LEHN'S KENNEL PERMIT REQUEST That the Applicant has applied for a conditional use permit as required by City Ordinance to maintain a private kennel. %9]at the Applicant appeared before the Planning and Zoning Commission at their regular meeting of October 6, 1981 to present his request. That ~aid public hearing was properly advertised and a copy of said public hearing notice is hereby incorporated as a part of these findings. 4) That the standards for consideration are as follows: a) The property is zoned R-1 and this is not a permitted use. b) The adjoining properties are residential dwellings located on lots of various sizes. c) The closest similar known use is approximately two (2) miles away. d) There will be no change regarding traffic flow in the area. e) There are four known kennels in the City which to our knowledge have not caused any neighborhood problems. However, there are numerous individuals that probably should have conditional use permits for private kennels, as they do cause problems because of a lack of control. f) Properly maintained, the kennel will not affect the lifestyle of the neighboring residents in a rural setting. Further, it should not affect the enjoyment or value of properties in the vicinity. 5) That the criteria for approval/disapproval are as follows: I I I a) b) The Applicants request is to maintain three (3) adult dogs which properly maintained should not be detrimental to or endanger the public health, safety or general welfare and is not contrary to established standards as regulated by the City Code. That the proposed kennel will not be unsightly, undesirable or obnoxious in appearance and will not hinder the orderly and har- monious development of the City and the use of the district wherein proposed. ! I I I c) d) That the use will not be substantially injurious to the permitted uses nor unduly restrict the enjoyment of other property in the immediate vicinity nor substantially diminish and impair property values within the area. That the establishment of the use will not impede the orderly and normal development and improvement of the surrounding property for uses permitted in the zoning district.
