I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br /> <br />1) <br /> <br />2) <br /> <br />3) <br /> <br />PROPOSED FINDINGS OF FACT <br /> RE: WILLIAM LEHN'S <br /> KENNEL PERMIT REQUEST <br /> <br />That the Applicant has applied for a conditional use permit as required <br />by City Ordinance to maintain a private kennel. <br /> <br />%9]at the Applicant appeared before the Planning and Zoning Commission <br />at their regular meeting of October 6, 1981 to present his request. <br /> <br />That ~aid public hearing was properly advertised and a copy of said public <br />hearing notice is hereby incorporated as a part of these findings. <br /> <br />4) That the standards for consideration are as follows: <br /> <br />a) The property is zoned R-1 and this is not a permitted use. <br /> <br />b) The adjoining properties are residential dwellings located on lots <br /> of various sizes. <br /> <br />c) The closest similar known use is approximately two (2) miles away. <br /> <br />d) There will be no change regarding traffic flow in the area. <br /> <br />e) <br /> <br />There are four known kennels in the City which to our knowledge <br />have not caused any neighborhood problems. However, there are <br />numerous individuals that probably should have conditional use <br />permits for private kennels, as they do cause problems because <br />of a lack of control. <br /> <br />f) <br /> <br />Properly maintained, the kennel will not affect the lifestyle of <br />the neighboring residents in a rural setting. Further, it should <br />not affect the enjoyment or value of properties in the vicinity. <br /> <br />5) That the criteria for approval/disapproval are as follows: <br /> <br />I <br />I <br />I <br /> <br />a) <br /> <br />b) <br /> <br />The Applicants request is to maintain three (3) adult dogs which <br />properly maintained should not be detrimental to or endanger the <br />public health, safety or general welfare and is not contrary to <br />established standards as regulated by the City Code. <br /> <br />That the proposed kennel will not be unsightly, undesirable or <br />obnoxious in appearance and will not hinder the orderly and har- <br />monious development of the City and the use of the district wherein <br />proposed. <br /> <br />! <br />I <br />I <br />I <br /> <br />c) <br /> <br />d) <br /> <br />That the use will not be substantially injurious to the permitted <br />uses nor unduly restrict the enjoyment of other property in the <br />immediate vicinity nor substantially diminish and impair property <br />values within the area. <br /> <br />That the establishment of the use will not impede the orderly and <br />normal development and improvement of the surrounding property for <br />uses permitted in the zoning district. <br /> <br /> <br />
