I <br /> I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />PERFORMANCE CONTRACT WITH <br />THE CITY OF RAMSEY <br /> <br /> THIS AGREEMENT, made and entered into the day of September, <br />1981, by and between the City of Ramsey, located in Anoka County, State of <br />Minnesota, hereinafter referred to as the "City", and James Refrigeration <br />Company having its principal place of business at P. O. Box 24137, <br />Minneapolis, Minnesota, hereinafter referred to as the "Developer". <br /> <br /> WttEREAS, the Developer has applied to the City Council for a plat <br />approval of the proposed plat known as Marx Estates; and <br /> <br /> WttEREAS, the Developer has also applied to the City for a site <br />and design plan approval to use Lot 1 Block 1 of the proposed plat as a <br />superette and gas pumps; and <br /> <br /> WHEREAS, the City Council has given approval Of said preliminary <br />plat and site plan; and <br /> <br /> WHEREAS, the Developer is required as a condition of plat and <br />site plan approval to enter into a contract binding it to perform certain <br />acts and duties within a specified time as a contingency to the Council <br />approving said plat and site plan; and <br /> <br /> WHEREAS, the City Council requires that said contingencies be <br />performed in a timely manner,la bond for the performance of said contin-__ <br />gencies must be filed assuring the City of full performance within the <br />certain specified period of time; and <br /> <br /> WHEREAS, the Developer has agreed to perform said contingent <br />acts and duties in a timely manner; and <br /> <br /> WHEREAS, the City Council has agreed to and does grant its <br />approval to the Developers' plat known as Marx Estates contingent upon <br />and conditioned upon the Developers' agreement to perform said acts and <br />duties as are hereinafter set forth. <br /> <br />NOW THEREFORE, IT IS HEREBY COVENANTED AND AGREED, that the City Council <br />has granted its approval to Marx Estates plat and the site plans approval <br />conditioned upon and contingent upon the timely performance by the <br />Developers of the following: <br /> <br /> 1) That the Developer shall be responsible to meet certain City <br />requirements and for the total and complete installation on or before <br />June 1, 1982, all of the improvements to the plat and site plan that are <br />required to be installed as plat and site plan improvements by and under <br />the provisions of the City Code.
