I <br />I <br />I <br />I <br />I <br /> <br />~00 Metro ~quare Buil~½~g, 7th ~treet and Robert Street, Saint Paul, Minnesota 55101 Area 612, 291-6359 <br /> September 23, 1981 <br /> <br />TO: Metropolitan Area Government Officials <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br /> <br />I <br />I <br /> <br />A number of local officials have raised " <br /> q~e~lons in recent months regarding <br />certain local ordinance "override" provisions of the 1980 State Waste <br />Management Act. <br /> <br />Specifically, they have asked the Council for more information regarding the <br />respective powers of the Council and local governments in the establishment <br />operation of sanitary landfills, sludge ash landfills or other waste managem~n <br />facilities. . - <br /> <br />This letter is an a~temp% to answer the questions most frequently raised. <br /> <br />With the passage of the 1980 Waste Management Act, the Metropolitan <br />Council was given the responsibility of reviewing municipal, township and <br />county restrictions on waste facilities and on the transportation of solid <br />waste. <br /> <br />'With the Council's approval, local units of government can place restrictions <br />or conditions on facilities operated by the Metropolitan Waste Control <br />Commission (MWCC) for the disposal of sewage sludge and sewage sludge ash <br />disposal. These conditions may involve the construction, operation, inspec- <br />tion, monitoring and maintenance of a MWCC waste facility, and the use of <br />sewage sludge on private property. <br /> <br />l~e same 1980 law allows counties and other local units of goverment to have <br />ordinances that govern the transportation of solid waste. The law provides <br />that such ordinances must be r,easonable and do not prevent the transportation <br />of solid waste through and between counties an~ local'units of government. Any <br />licensed waste hauler, metropolitan county or municipality can request that the <br />Council review such an ordinance. That law states that disapproval by the <br />Council invalidates the ordinance. <br /> <br /> The Waste Management Act gives the Council and the seven metropolitan counties <br /> authority to override city or township ordinances that prevent the establish- .. <br /> ment of county solid waste landfills and resource recovery facilities. A <br /> county may establish such facilities without complying With local ordinances, <br /> if the action is approved by the Council.
