'1 <br /> I <br /> I <br />,I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />Criteria <br />lOa. <br /> <br />lOb. <br /> <br />10c. <br /> <br />lOd. <br /> <br />Restrictions imposed by local governmental units on waste facilities <br />should address social, economic, aesthetic or land use factors of a.- <br />facility such as transportation of waste, access, routes, hours of <br />operation, performance standards, bonding, end use, landscaping and <br />other factors that may potentially impact the surrounding community. <br /> <br />Restrictions imposed by local governmental units on waste collection <br />services should address environmental and socio-economic factors <br />including access routes, hours of operation, noise and container size <br />and material that may impact the community. <br /> <br />Facility need, capacity, technical and environmental factors such as <br />protection of surface and groundwater supplies, surface water drain- <br />age, protection of surface water quality, monitoring liquid and gas <br />emissions and facility design plans which are the authority of state <br />environmental protection, and health agencies (i.e., MPCA, MDOH, Metro- <br />politan Council, DNR) should be addressed by the MPCA and Metropolitan <br />Council and considered by local governmental units during the. MPCA and <br />Council permittfng processes. <br /> <br />Local restrictions or conditions upon waste facilities receiving state <br />permits should not unduly restrict or prevent the establishment or~ ...... <br />operation of waste facilities. Local restrictions shall be compatible'~i~. <br />with and shall not conflict with state permit conditions. Further~ ...... <br />more, restrictions shall not impair collection services or the <br />regional waste management system. The Council shall considen the <br />following'factors during the review of a local condition: . <br /> <br />Extent to which the condition mitigates local environmental, <br />socio-economic and developmental impacts; <br /> <br />0 <br /> <br />Extent to which the condition impairs the operation of the <br />facility, collection services or other aspects of the regional <br />waste management system; <br /> <br />o <br /> <br />0 <br /> <br />Degree, nature and utility of the difference between the local <br />restriction and federal and state requirements; and <br /> <br />The need, justification and adequacy of a more restrictive loca.1 <br />condition. <br /> <br /> <br />
