D,~,.,, 20226 <br /> <br />OFFICE OF THE SECRETARY OF THE TREASUR -: . , <br /> /- OCT 1981 <br /> <br />Dear Chief Executive: <br /> <br /> On Friday, August 14, 198t, we published in the Federal Register <br />on page 41047 a notice that certain portions of our regulations implement- <br />ing Section 504 of the Rehabilitation Act of 1973, as amended, are <br />now in effect on an interim basis. Section 504 prohibits discrimination <br />on the basis of handicapped status. Any prohibition in that Act also <br />applies to any program or activity of a recipient government which <br />is funded in whole or in'part with-revenue sharing funds. <br /> <br /> The notice gives interim effect to regulations published in the <br />Federal Register on January 5, 1981. These regulations did not take <br />effect as scheduled because of President Reagan's freeze on regulations. <br />Pursuant to Executive Order 12291, entitled "Federa.1 Regulation," <br />the regulations were further deferred pen~ing reconsideration of the <br />Federal government's guidelines on which our regulations are based. <br /> <br /> Due to recent developments in the case of Paralyzed Veterans <br />of America et al. v. Smith, etc., et al., United States District Court, <br />Central District of California, No. 79-1979 WPG, we were obligated <br />to issue the Revenue Sharing handicapped regulations. Therefore, the <br />regulations published on January 5, 1981 are now in effect, with the <br />exception of the followi'ng sections, which-are indefinitely deferred: <br /> <br />- Section 51.55(b)(1)(ix) - which .prohibits <br /> discrimination in the exercise of zoning <br /> authority. <br /> <br />- Section 51.55(c) - self-evaluation requirement. <br /> <br />I <br />I <br /> <br />- Section 51.55(d) - designation of responsible <br /> employee and adoption of grievance procedures. <br /> <br />- Section 51.55(e) - notice. <br /> <br />- Section 51.55(f) - administrative requirements <br /> for small recipient governments. <br /> <br />- Section 51.55(k)(4) - time periods (concerning <br /> accessibility requirements). <br /> <br /> The sections listed above will continue to be deferred until <br />the Department of Justice completes a review of the overall Federal <br />government's guidelines. At that time, these sections will be reconsidered <br />in light of the revised guidelines and either be put into effect, <br />modified or deleted. <br /> <br /> <br />
