I I I 'i I I I I I I I I I I I. RESOLUTION #81- RESOLUTION TO (NOT) DELETE SPECIAL ASSESSMENTS REGARDING STREET IMPROVEMENT PROJECT #80-17; CASE OF MR. JAMES PROVINZINO, 6304 HIGHWAY #10 (PLAT 89329, PARCEL 1590): WHEREAS, Mr. James Provinzino stated at the public.hearing held on September 8, 1981, which was held to adopt the special assessments for Public Improvement P~oject #80-17 (bituminous surfacing of Tungsten Street) that he should not be assessed for the. above Street Improvement Project, as he did not receive a benefit from it, and WHEREAS, the City Council, City of Ramsey, Anoka Co~ty, State of Minnesota did, at this regular Council meeting on September 8, 1981, direct City Staff to prepare a Findings of Fact regarding the legality of assessing Plat 89329 Parcel 1590 for the above street improvement, and WHEREAS, the City Staff did submit a Findings of Fact to the City Council at their regular meeting of September 22, 1981, and WHEREAS, the City Council, City of Ramsey, 'Anoka County, State of Minnesota did adopt the Findings of Fact on September 22~ 1981, 'and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, cITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the one'(l) unit special assessment in the amount of $200 levied against .Plat 89329 Parcel 1590 be'deleted in its entirety, based on the adopted Findings of Fact, dated September 22, 1981. 2) That the above deleted assessment in the amount of $200 will become the City's share of cost. - 3) It is fumther directed that the following Administrative action be accomplished on this case: a) That the City Accountant be furnished a copy of this resolution so %hat the .appropriate action may be taken in the accounting and assessment records. b) Tha~ a certified copy of the City CounCil motion adopting the Findings of Fact and a ~copy of the Findings of Fact be attached to this resolution'as enclosure .(a). ¢) That a copy of this resolution with enclosures be filed in Improvement Pm6ject ~80-17'a file~ d) That Mm. James Pmovinzino, 6304 - Highway ~10, be furnished a certified copy of this resolution with enclosures.
