AlsO enclosed is the <br />transcript and an errata sheet relating to the transcript. <br /> <br /> You have raised two questions in connection with this <br />proceeding which are addressed below. <br /> <br /> You have asked us to explain the source of the Agency's <br />interpretation of the terms "lake, pond or flowage," "stream," and <br />"wetland" to include only bodies of water of a certain size or <br />eligible for a certain classification. These terms appear in the <br />rules and criteria adopfed by the Minnesota Pollution Control <br />Agency (MPCA) to evaluate the sites proposed by the metropolitan <br />counties as to their intrinsic suitability for use as solid waste <br />disposal sites and are interpreted in the Glossary included by the <br />Director in his "Report on the Director's Proposed Recommendation" <br />as follows: <br /> <br />LAKE, POND OR FLOWAGE - In an incorposared area a lake, pond <br />or flowage is a body of water 10 acres or more in size. In <br />an unincorporated area a lake, pond, or flowage is a body of <br />water 25 acres or more in size. The official determination <br />of the area of a lake, pond, or flowage is made by the <br />Department of Natural Resources. <br /> <br />STREAM OR RIVER - A channelized waterway with a total <br />drainage area of two square miles at any point.
