The Developer agrees that the owners of the remaining lots which are not included in paragraph 8., above, in Flintwood IIills Second Addition, upon which buildings have been erected shall connect to a public sanitary sewer system within one (1) year of the date on which the City of Ramsey has completed such sanitary sewer project to service said lots. 10. The Developer agrees that all of the individual lots in Flintwood }{ills Second Addition shall be subject to special assessments to be levied by the City of Ramsey, pursuant to statute, for the installation of said sanitary sewer project and any other City improvement project, if such projects are installed, and the liability for payment of such assessments, if any, shall be borne by the then individual lot owners. The parties hereto agree that the liability of the Developer, hereunder, is limited to only the actual costs of the improve- ments described in paragraphs 1. and 2., above, it being understood that the costs arising from the installation of any other improvement shall be assessed by the City to the individual lots contained within said plat. 11. The Developer, for itself, its successors and assigns, hereby covenants and agrees not to contest the determination by the City of Ramsey, if any, that the installation of said sanitary sewer system to service the lots contained in the plat herein is necessary, in the public interest, and of benefit to said lots. 12. That the City's required park fee shall be $500.00. Said a~ount shall be paid to the City by the Developer at the time the City ex,cutes the final plat. 13. That the Developer hereby agrees, for itself, its successors and assigns, thai Developer shall maintain, at its sole expense, the drainage ponding'areas over and across -5-
