DENNIS' SHARP: <br /> <br />Motion by Councilman Cox, seCOnded by Councilman Sorteberg to adopt <br />Resolution #81-114 giving tacit approval to an Industrial Revenue Bond <br />to Mr. Dennis Sharp. (Please refer to resolution file for Resolution <br />#81-114). Motion Carried. Voting Yes: Mayor Gamec, Councilmembers Cox, <br />Van Wagner, Sorterberg and Reimann. Voting No: None. <br /> <br />CASE #10 -HEXON REGARDING THE BOX CAR ISSUE: <br /> <br />City Attorney Goodrich stated that Councils motion was that we take~iHexon <br />to court for moving in a box car without City approval. The court's <br />decision was a $150 fine and 30 days in jail, the 30 days being suspended <br />if Mr. IIexon complies with the City Code for one year. The next step is <br />to inform the County if he is or is not in compliance with the City Code. <br />If he is not, the County will proceed to invoke the 30 day sentence. <br />City Administrator Schnelle stated that if the box car is going to be used <br />as a place of storage, it will have to be inspected by a building inspector. <br />If it is to be used as a place of business, it will have to be inspected <br />by a structural engineer. Does the Council want it inspected or removed. <br />At this time, Mr. Hexon presented copies of a letter to him from Graphic <br />Design Architects dated July 28, 1981, stating they could not take on the <br />project since matter was pending in court. ~-~ <br /> <br />Building Tnspector Berg stated he had been out to the site but had not <br />performed an actual inspeciton. <br /> <br />Mr. Hexon stated the delay On his part was due to injuries sustained in <br />an accident. <br /> <br />Mayor Gamec informed Hexon that he has had plenty of opportunities to <br />comply with the ordinance, that the city has been more than lenient and <br />that he does not feel the structure will meet code requirements. <br /> <br />Mr. Hexon replied that the box car is now gOing to be used for storage. <br /> <br />Mayor Gamecs advice was to deny Hexon's request, because the City does <br />not want a lot of box cars sitting around without being dressed up. <br /> <br />Councilman Cox stated that if it was not going to be permitted, why did <br />we choose he-come in with a Site' '3 Design Plan? Now we have a directive <br />from Court that he is to be in compliance with the City Code. If it ' <br />wasn't an offensive idea to the Council in the first place, why. are we <br />now stating that it does not fit into the conmmity? <br /> <br /> Mayor Gamec replied' that when Mr. Hexon first brought in the box car, <br /> it hadn't been inspected. '- -·· · . <br /> <br /> Councilman Cox replied that we have a letter from Berg stating he did <br /> visit the site. If Council is going to be this harsh, we have other <br /> offenses in the City of Ramsey, that are just as bad, that we have done <br /> nothing about.
