Enforce- ment of the deadline would be in the same manner as described above. RECOMMENDATIONS I I ! A. That the Council deal with suspended plan reviews in the following way: (1) Those local governments which have provided estimates of when new information will be submitted to satisfy a suspension should be notified that the date will be considered final by the Council. (2) Those local units which have not provided estimates should be notified that they have two months from the date of suspension or 30 days from adoption of these guidelines, whichever is later, to comply. (3) Future suspensions should include notice that no more than two months will be allowed to satisfy the suspension. I I I I (4) (5) In all cases, the sponsoring local governments should be forewarned that missing the deadline established by the abo~e method will be treated as if no plan has been submitted and will result in loss of planning 9rant entitlement eligibility. Further,.missed deadlines may lead to negative A-95 and similar Council reviews where actions are not clearly consistent with regional plans and policies, and ultimately to legal action to enforce the MLPA. Local units of government unable to meet the applicable suspension deadlines established above, should be further advised that the Council may consider a longer deadline if exceptional circumstances or undue hardships can be documented. These situations will be decided case-by- case based on their merits. B. That the Council handle local governments which have not yet submitted a comprehensive plan in the following way: ! I I (2) All such units should be notified that the final deadline for sub- mitting comprehensive plans is 30 days from adoption of these guide- lines. They should also be advised that failure to meet the deadline will mean the Council will enforce the deadline through the same provisions described in Recommendation A(4). The case of Landfall should be investigated by the Office of Staff Counsel and Local Planning Assistance staff, and a recommended course of action be presented to the Council by September 30.
