The full width of the right-of-way of each street-and~ alley shall be graded, including the subgrade of the areas to be paved, in accordance with the standards and specifications established by the city. 2. /O.] streets in the i990 urban area and the transitional area, as defined by the l.~3msey fJty Zoning Code, shall be paved with concrete or bituminous surfacing in accordance with the standards and specifications which have been adoptec by resolution of the city council. 3. Ali_ private driveways providing access to public right- of-way shall approach to grade level. 4. Street signs of a design approved by the city shall be tinstal]ed at each street intersection at the subdivider's expense. 5. Minimum city road construction standards must be met for one (1) year from the date of final acceptance of the street. In order to insure that the street is constructed in the proper manner, the sub- divider shall post a surety bond ~or other satisfactory security in the amount of Five Thousand Dollars ($5,000.00) per strget mile, with a minimum of Five Thousand Dollars~($5,000.00); any fraction of a mile shall be considered a full mile. If the city engineer determines, during or at the termination of this one (1) year period, that the street has not been properly constructed, the developer shall be notified to remedy the problem. If he does not do so within a rea- sonable time, the city may use the money deposited as security to perform the necessary corrective construction. 6. No building permit shall be issued for any lot in the subdivision until the improvements required by the performance contract have been completed and accepted by the city, except that building permits may be issued if the only improvement to be completed is that of the final street surfacing. Between the period of issuance of the first building permit and the city's final acceptance of the street, the city will snowplow the street only and will provide no other street maintenance on said street. 170. 039J DRAINAGE FACILITIES Storm sewers, culverts, and wa~er drainage facilities shal~ be required when, in the opinion of the city engineer, such facilities are neces- sary to insure adequate drainage for the area. All such drainage fac- ilities shall be constructed in accordance with standards and specifi- cations established by the city. 170.039K SUBSURFACE CONDITICNS The 'subdivider shall cause tests to be made of subsurface conditions to de%e~rmine the nature and extent of subsurface soil, rock and water.
