Environmental Policy Board (EPB) 5. 2. <br />Meeting Date: 02/22/2016 <br />By: Chris Anderson, Community <br />Development <br />Information <br />Title: <br />Consider Ordinance #16-03 Establishing a Permanent Setback from Wetlands and Storm Water Ponds in <br />Accordance with the Provisions of the Lower Rum River Water Management Organization's 3rd Generation Plan <br />Purpose/Background: <br />Ramsey is a member city of the Lower Rum River Watershed Management Organization (LRRWMO) and thus, is <br />subject to the standards and provisions of the LRRWMO's 3rd Generation Plan. That document outlines measures <br />that must be implemented by member cities (Ramsey, Andover and Anoka) that, among other things, protect <br />wetlands throughout the development process. One such standard is a required setback of one (1) rod (the <br />equivalent of 16.5 feet) from all delineated wetlands and storm water ponds. The vegetation within this required <br />setback must be left undisturbed throughout the development, building, and landscaping phases of a project. The <br />purpose of this case is to consider Ordinance #16-03, which would establish this setback standard in Ramsey's City <br />Code, in accordance with the LRRWMO requirements. <br />Notification: <br />The City will publish a notice of public hearing in the Anoka Union Herald, the City's official newspaper in <br />accordance with state statutes. <br />Observations/Alternatives: <br />The draft Ordinance addresses two primary topics, wetland setbacks and buildable area of a lot. The Ordinance <br />establishes the required setback of sixteen and a half (16.5) feet adjacent to all wetlands and storm water ponds and <br />specifies required submittal information and prohibited activities within the setback area. The setback will need to <br />be identified on the grading, drainage and erosion control plan and/or be identified on a separate plan sheet and will <br />also need to be encumbered by a drainage and utility easement. The City already requires wetlands and storm water <br />ponds be encumbered with drainage and utility easements out to the designed or designated 100 -year flood <br />elevation. Oftentimes, the sixteen and a half (16.5) foot setback will fall within this area, resulting in no additional <br />restrictions or limitations on a lot. <br />The Ordinance also establishes a minimum lot depth to help eliminate future issues with potential encroachment <br />into wetlands. The intention of the lot depth standard, which would be in addition to the minimum lot area and <br />width standards outlined in the bulk standards of individual zoning districts, is to ensure there will be adequate <br />'usable' space in the rear yard to account for common homeowner improvements like decks and accessory <br />buildings. <br />Funding Source: <br />This case is being handled as part of Staffs regular duties. <br />Action: <br />Motion to recommend City Council adopt Ordinance # 16-03. <br />Attachments <br />
