Buffer Law— Failure to Implement Policy <br />SWCDs. <br />A. May issue a validation of compliance when requested by a landowner. (Subd. 3(d)) <br />B. Must develop, adopt and submit to each local water management authority a summary of watercourses by <br />July 1, 2017 for inclusion in the local water management authorities' plan. (Subd. 4) <br />C. Must assist landowners with implementation of the water resource riparian protection requirements <br />including: planning, technical assistance, implementation of approved alternative practices, and tracking <br />progress towards compliance with the requirements provided in Minnesota Statutes 103F.48, Subd. 3. (Subd. <br />6) <br />D. Must notify the county or watershed district with jurisdiction when it determines a landowner is not in <br />compliance. (Subd. 7) <br />E. Must grant a conditional waiver to a landowner: (a) who has applied for and maintained eligibility for <br />financial assistance within one year of the compliance dates in Minnesota Statutes 103F.48, subd. 3(e); or (b) <br />are subject to a drainage proceeding. (Laws of Minnesota 2015, 1st Special Session, Chapter 4, Article 4, <br />Section 146). <br />Counties. <br />A. Must amend its comprehensive local water management plan to incorporate the SWCD recommendations. <br />(Subd. 4) <br />B. Must provide the landowner with a list of corrective actions needed to come into compliance and a practical <br />timeline to meet the riparian protection requirements when notified by the SWCD that a landowner is not in <br />compliance. A copy of the corrective action must be provided to BWSR. (Subd. 7(a)) <br />C. May adopt an administrative penalty order plan. (Subd. 7(b)). <br />Watershed districts. <br />A. Must amend its comprehensive watershed management plan to incorporate the SWCD recommendations. <br />(Subd. 4) <br />B. Must amend its comprehensive watershed management plan to incorporate the SWCD recommendations. <br />(Subd. 4) <br />Policy. <br />It is the policy of the Board of Water and Soil Resources that failure to implement/non-implementation of the law is <br />defined as when a county, watershed district, metropolitan watershed management organization or SWCD has been <br />determined to not have been implementing one or more of the following duties: <br />1.
