A~rport hazards have a substantial adverse <br />effect upon the safe and efficient use of the airport by <br />aircraft and upon the safety of persons and property located on <br />or near the airporti The term object as used in the following <br />paragraphs includes~ but is not limited to, above ground <br />structures, people, le~uipment, vehicles, aircraft, natural <br />growth, and terrain." <br /> <br />"The following objects are airport hazards and must be removed" <br />(cessation of use may constitute removal) - parenthetical added. <br /> <br />I, i · <br /> <br />Garbage dumps or landfills located within 5,000 feet <br />(1500 m) of a non-turbojet runway or 10,000 (3000 m) of a <br />turbojet runway that may attract birds on or around an <br />airport." <br /> <br />"18. ZONING AND LAND USE ~COMPATIBILITY <br /> <br />A. Land Use. UnconStrained use of land adjacent to or in the <br /> <br />immediate vicinity of the airport can directly affect the <br />efficiency and capacity of the airport. Airport authorities <br /> <br />should: <br /> <br />(l) <br /> <br />Prevent the Construction, erection, alteration, or <br />growth of any structure, tree, or other object in the <br />approach ar~as of the runway or the airport, which would <br />constitute an airport hazard; and <br /> <br />(2) <br /> <br />Restrict the use of land adjacent to or in the immediate <br />vicinity of the airport to activities and purposes <br />compatible with normal airport operations including <br />landing and takeoff of aircraft. <br /> <br />This may be accomplished by acquiring and retaining ease- <br />ments, other interest, or rights for the use of land and <br />airspace; or by adopting and enforcing zoning regulations." <br /> <br />MR7035.160 addresses prohibited areas for landfill sites, <br />among which are locations considered hazardous because of the <br />proximity of airports. <br /> <br />Chapter 326 Subd. 3 and Chapter 360.061 to 360.074, laws of <br />Minnesota provide a basis for airport zoning. <br /> <br />RECOMMENDATION: <br /> <br />No change in Zoning Ordinance or plan is required. <br /> <br />Adoption of airport zoning, ordinance by the City of Ramsey.does not <br />permit development to occur and thus is not in conflict with statutes. <br />Metropolitan Council's approval is not required for airport zoning, <br />however, the airport is identified in MC's Aviation System Plan as well <br />as state and national plans. . <br /> <br />3 <br /> <br /> <br />
