That because of thai hSgh water table on Lots 9,10,11~&12, Block 6~ I,ol: 1, Block 7, Lot~ $ &&-~ Block 8, Lot 1, Block 9, and Lot 1, Block;lC, in Barthel's Rum Ri~e~ Acres Second Addition the deeds on these lots cont:ain~ a restricti~e~covCnant stating that there be approval by the Butlding official o~ ~he Complete design including sewe~, building lo~a. tio~, fill ect.~bSfor¢ a b~ilding permit be issued. 2.) Plat subject ~o pay~e~t of park fee. 3.) Tha~ above mentione¢ ~estrictive covenant be subject to City Attorney an~ Adm~nistrator's~a~pro~al[. 5 ayes 2 nayes Art Dunn voted no stati~g~he was Opposed due to the water table and that he fa~t the lots should be~f~lled prior to aDproval. Motion by Kathy Schneid~r,~ seconded by Ken Peterson to recount, end to the City Cou[ncil to deny th~ r~que'st by Mike Rausch for a special us¢~ permit for a home occupation o~ a~book and bible store since it was inconsistent with the c~ty ordinance.~ 6~ayes - Gerry Zimmerman voted no.
