9. That the Permittee shall execute and record a Cross Access Easement against the Subject <br />Property as well as the property generally known as 7850 Riverdale Dr NW. <br />10. That the Permit specifically prohibits the use of outdoor speaker devices. <br />11. That the Permit specifically limits the hours of operation of the motor vehicle detailing <br />business to between 7:00 AM and 7:00 PM Monday through Saturday. <br />12. That the Permittee must comply with public nuisance ordinance requirements related to <br />inoperable vehicles and other public nuisances as outline in City Code Chapter 30 on the <br />Subject Property. <br />13. That the Permittee shall replace any bufferyard trees that die with evergreen trees meeting <br />the minimum size requirements in City Code to maintain adequate screening from the <br />residential property to the south. <br />14. That this Permit shall be perpetual in duration as long as the terms are herein complied <br />with. <br />15. That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br />16. That the Permittee shall obtain all required permits, including a Building Permit for any <br />modifications to the existing building on the Subject Property as well as any applicable <br />permits or licenses from other regulatory agencies and shall provide copies of said permits <br />or licenses to the City. <br />17. That the City Administrator, or his/her designee, shall have the right to inspect the Subject <br />Property for compliance and safety purposes annually or at any time, upon reasonable <br />request. <br />18. That this Permit shall automatically expire if the use is not initiated by May 24, 2017 and <br />commencement of expansion of the parking lot shall constitute initiation. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Kuzma, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Strommen <br />Councilmember Shryock <br />Councilmember Kuzma <br />Councilmember Johns <br />Councilmember Riley <br />Councilmember Williams <br />RESOLUTION #16-05-095 <br />Page 2 of 4 <br />
