Date by which work is to be completed. <br />(2) Failure to comply with this notice will result in an order to stop work on the site. <br />(b) Violation a Misdemeanor; Penalty. Any person (firm, or corporation) who violates any section of <br />this subdivision or obstructs city staff or their representatives from carrying out their duties, shall <br />be guilty of a misdemeanor and, upon conviction thereof, shall be punished as defined by state <br />law. <br />Chapter 117 Division 3 Sec. 117-614 (h) is amended to include the following: <br />(11) Buildability Requirements. All lots shall have the lowest floor a minimum of three (3) feet <br />above the seasonal high water mark or two (2) feet above the designated or designed 100- <br />year flood elevation, whichever is higher, unless evidence is submitted and certified by a <br />geotechnical engineer that shall be reviewed and certified by an independent geotechnical <br />engineer hired by the city at the expense of the developer and approved by the City Council <br />that a separation of less than three (3) feet can be achieved and is warranted. <br />a. Residential lots. Residential lots shall have a lot depth of not less than 100 feet for a <br />continuous width of sixty (60) feet, exclusive of any wetland, wetland setback area, <br />floodway, or steep slopes. <br />SECTION 3. SUMMARY <br />The following is the official summary of Ordinance #16-03, which has been approved by the City Council <br />of the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. <br />It is the intent and effect of Ordinance #16-03 to amend Ramsey, Minnesota City Code Chapter 117 <br />Subdivision VI to establish a permanent setback adjacent to wetlands and storm water ponds for lots of <br />record created after the adoption of this ordinance in accordance with the Lower Rum River Water <br />Management Organization's 3`d Generation Plan and to establish a minimum lot depth for residential parcels <br />exclusive of any wetland, wetland setback area, floodway, or steep slopes. <br />SECTION 4. EFFECTIVE DATE <br />The effective date of this Ordinance is thirty (30) days after its passage and publication, subject to City <br />Charter Section 5.07. <br />Adopted by the Ramsey City Council the 10th day of May, 2016. <br />ATT <br />Ci Clerk <br />
