Chairperson Nixt asked if Mr. Fitzpatrick had a project now. Mi'. Fitzpatrick indicated he does
not. He stated when he filled out the application he wanted B-2, but now he wants mixed use.
He indicated one concern in a letter was that it would be a car lot, but mixed use would not allow
that; car lots are only permitted in B-2.

Motion by Chairperson Nixt, seconded by Commissioner Brauer to close the public hearing at
8:10 p.m.

Motion carried. Voting Yes: Chairperson Nixt, Commissioners Jeffrey, Brauer and Shepherd.
Voting No: None. Absent: Commissioners Johnson, Van Scoy and Watson.

Commission Input

Mr. Fitzpatrick stated he asked Staff' for the materials that should have been sent, and what he
received was what looks like a newsletter. He indicated he does not read the City newsletters,
and if he did he would not be able to find his house on the map, and he is 1 ½ miles from the
critical boundary area shown, so he would not have thought he was affected.

Commissioner Jeffrey asked if the property before the roadside rest is another low-density lot.

Assistant Community Development Director Trudgeon stated it is.

Chairperson Nixt indicated the City received a letter of objection from that homeowner, citing
among other things increased traffic on Highway 10. He stated his view is that while a mixed
use may ultimately be appropriate given the location and proximity to the wayside rest, he would
not be inclined to approve at this time, but would be open to the request with an appropriate
project.

Commissioner Brauer agreed. He stated he is not in favor of development on the river, and voted
against even R-2, which are towl~ouses.

Motion by Chairpersbn Nixt, seconded by Con-unissioner Brauer to recommend that the City
Council deny the request for a Comprehensive Plan Amendment.

Motion can'ied. Voting Yes: Chairperson Nixt, Commissioners Brauer, Jeffi'ey and Shepherd.
Voting No: None. Absent: Commissioners Johnson, Van Scoy and Watson.

Case//4

Public Hearing - Request to Rezone Certain Property from R-1 Residential
to B-2 Business; Case of Patrick Fitzpatrick

Presentation

Assistant Community Development Director Trudgeon indicated this is related to the previous
case, and should be voted on separately.

P8

Planning Commission/May 6, 2004
