City Attorney Goodrich replied they would likely go before the EDA for review prior to being <br />considered by the Council. The operating company and the landowner may have different <br />names. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Strommen, to introduce an <br />ordinance which is an ordinance authorizing the sale of Lot 2, Block 1, Sunfish Lake Business <br />Park Second Addition. <br /> <br />Motion carried.. Voting Yes: Mayor Gamec, Councilmembers Kurak, Strommen, Cook, Elvig, <br />Pearson, and Zimmerman. Voting No: None. <br /> <br />Case #15: Consider Ramsey Town Center Park Proposal <br /> <br />Assistant Public Works Director Olson reported on April 7, 2004, the Parks Cormnission <br />recommended' that the City Council approve the proposal of the Parks plan for Ramsey Town <br />Center that was dated February 19, 2004, contingent upon the developer including the following <br />features in the specified parks: <br /> <br />West Town Center Park <br /> <br />Open Air pavilion (100-150 people) with permanent <br />restroom facilities <br /> <br />East Town Center Park <br /> <br />Amphiteater <br /> <br />South Park <br /> <br />Open Air pavilion (100-150 people) with permanent <br />restroom facilities <br /> <br />North Park <br /> <br />Grading, trees, and roadway trails only with all future <br />graphics to show the swim pond <br /> <br />All Parks <br /> <br />Irrigation for all .manicured lawn areas <br /> <br />Assistant Public Works Director Olson explained there is a g'reat deal of imagery and <br />construction drawings that are near completion. The parks proposal is to provide 4.2 million <br />dollars in improvements and.roughly 2.1 million dollars in land for park purposes. It also states <br />the developer will contribute $1,500 per building permit that is issued into an escrow under his <br />control for Civic Square and Downtown Cormnons. This agreement would amend the Master <br />Agreement by adding a new Section 15.3(e) which reads "Failure by the Developer to perform <br />the Developer's obligations under the Parkland Trail Plan Agreement for Ramsey Town Center <br />effective as of the __ day of ., 2004." He explained the letter of credit is not needed because <br />the value of the land serves as the credit. <br /> <br />Councihnember Elvig indicated Section 7.2 should require the developer to supply the City with <br />evidence of filing. <br /> <br />Councihnember Elvig suggested Section 7.4 include a statement specifying a reasonable period <br />of time and just cause in relation to performance of any of the obligations. <br /> <br />P52 <br /> <br />City Council/April 27, 2004 <br /> Page 30 of 33 <br /> <br /> <br />
