10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />That the Applicants are proposing that a single family dwelling be constructed on the Subject <br />Property. <br /> <br />That the Subject Property is landlocked and has no frontage on a public road and the literal <br />interpretation of City Code Section 9.11.0i would prohibit the development of a single <br />family dwelling on the Subject Property and therein deprive the Applicants of rights <br />commonly enjoyed by other properties in the same district, resulting in an undue hardslzip. <br /> <br />That the City has previously granted similar variances for this property. <br /> <br />That on September 10, 2001, the Board of Adjustment granted a variance to minimum lot <br />width to the Applicants for the Subject Property,. <br /> <br />That on December 5, 2002, the Board of Adjustment granted an extension to the variance to <br />minimum tot Width to the Applicants. <br /> <br />That on September 10, 2003, the variance to lot width for the Subject Property expired by the <br />fact that the Applicants had not commenced construction of the home on the Subject Property <br />at that date. <br /> <br />That the special landlocked conditions do not result from the actions of the Applicant. <br /> <br />That the variance requested is/is not the minimum variance which would alleviate the <br />hardship. <br /> <br />That if granted, the variance will/will not permit a use that is prohibited in the R-1 Rural <br />Developing District. <br /> <br />That the granting of the variance will/will not grant the Applicant any special privileges .that <br />are denied by this Chapter to other owners of land in the same district. <br /> <br />That if granted, the variance will/will not impair an adequate supply o~' light and air to <br />adjacent property. <br /> <br />16. That if granted, the variance will/will not be materially detrimental to the purposes of this <br /> Chapter or other property, in the same zone. <br /> <br />17.
