C o r'FSe t.. i0 <br /> <br />Cotmcihncm bcr <br /> <br />..... introduced the following resolution and moved for its adoption: <br /> <br />NE$OLUTION 04-06-XXX <br /> <br />A RESOIJUTION REQUESTING THE TAX FORFEIT PROPERTY KNOWN AS <br />OUTLOT A RIVERSIDE WEST BE RETAINED AS PUBLIC PROPERTY FOR THE <br />USE AS DRAINAGE AND UTII,ITY EASEMENT. <br /> <br /> WHERE^S, on September 1l, 1998 deed number 189294 was issued to the City of <br />Ramscy for Outlet A, Riverside we;.;t subdivision as tax forfeit property for use in the straightening <br />and widening o F ] 37~h Avcnt~c NW, and; <br /> <br /> WHEREAS, in tho subseque~t five years after obtaining this parcel the City has not <br />straightened or widened 177th Aven~te NW, and; <br /> <br /> WIIEREAS, tax forfeit progcr[y which is not in use after five years for its stated purpose <br />must revert back to lhe state,, and; <br /> <br /> WIIEREAS, said Outlet A would serve public purpose as a drainage and utility easement <br />in thc event that repair or replaccme~t oFthe Dolomite Street sewage lift station is necessary, and <br /> <br /> WtlERgAS, the attached, aoplication for Approval of a New Use of Tax Forfeited Land <br />makes possible an atdjustment of th,: public use for which the tax forfeited property was obtained, <br />and; <br /> <br /> WH Elit EAS, on March 23, ~ 00~ the City Council passed Resolution 04-03-070 authorizing <br />and directing that an Application of a New Use of Tax-Forfeited Lands of said Outlet A be <br />submittcd for a ncx,v usc ora drainagto and utility easement, and; <br /> <br /> WltEREAS, the City has b::en advised that Anoka County would want the City to retain <br />title rather than oblain an easement o ~er the subject outlet. <br /> <br /> NOW THEREFORE, BE 1!' RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. ri'hat t~,esolutior~ 04-0:i-070 is hereby rescinded. <br /> <br />That thc City Engineec is hereby attthorized and directed to submit an Application <br />fbr Approval oF a New Use o f tax Forfeited Lands for Outlet A Riverside West <br />subdivision for the ne,u uso of drainage and utility easement. <br /> <br />The motion For thc adoptio~a of the foregoing resolution was duly seconded by Councilmember <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />RESOLUTION 04-06-XXX <br /> 1 of 2 <br /> <br /> <br />
