Motion carried. V~>ting Yes: Iloa~d Members Jeffrey, Brauer and Shepherd. Voting No: None.
Absent: |~oard Mc-tubers .l~hnson, x/an Scoy and Watson. Chairperson Nixt abstained.

I'UiIIAC ilEA R I.'~(;S/BOAR D B ~JSi_NESS

Case #1:

[(equest for a Variance to Construct an Accessory Structure Nearer the
~'ront Property Li~,~e titan the Principal Structure; Case of Stephen and Nila
Dchcn

l'rcscntation

Community l)cvclopment f)irecto~ I:'rolik advised Ramsey City Code states that on properties
less than two acres in size, no acc~:sso~'y structure shall be constructed nearer the front property
linc than the principal structure. M :. and Mrs. Dehen have applied for a variance to construct an
accessory structure nearer thc I'ront property line at 14720 Bowers Drive NW. Bowers Drive is
considered the li'ont yard and the lXlississippi River is considered the back yard. She stated that
in 1985 the City adopted rcgulati~ms for properties within the Critical River Corridor. She
advised one el' thc regulations is theft ~here shall be a 200 foot structure setback from the ordinary
high water mark. :<;he indit.:ated thc:: I)<~hen's house is approximately 190 feet from the ordinary
high water mat'k, ~nd is considerc(l lawful non-conforming. She stated placement of the new
garage in thc bacl~ yard between tl~e house and river would intensify the encroachment of the
river setback.

Community I)cvcl.:,~pment I)irecto~ I"rolik explained the better alternative is to construct the
garage in thc fl'(mt yard. She state-t the home on the property is located approximately 74 feet
fi'om thc fi'out t~'operty line, ';'he Dehens are proposing to construct the new garage
approximately 10 i'cct from thc fr(~nt property line and 260 feet from the ordinary high water
mark. She indicated similar varia~ces have been granted in the past, some of which were for
properties along [~owcrs l)~'ive. Sl',e stated, however, in many of the previous instances along
Bowers l)rivc, thc homes were mt,~& closer to the river and thus provided ample room in the
fi'ont yard to at least meel thc minimmn front yard setback of forty feet. She indicated there is
screening, in iht: l'om~ of trees and t:~ll shrubs, along the front and both side property lines, which
would help to c¢mc,,,~al the proposed .;tructure fi'om the public road and neighboring properties.

Public I learing

Stove Dchcn, 147~0 Bowers Drive stated they want to get another structure, as they own two
boats and two lrail~rs and do not w~mt it all exposed and have the yard look like a junk yard. He
would have siding ~o match the hour;e, so the structure would blend in.

Chairperson Nixt it~dicated staler is suggesting the size be reduced to accommodate a 15 foot
setback. Ilo asked il'this would me(.t ti'lo applicant's needs.

Mr. l)chen stated hc would like it t!~e size he requested. He indicated there is an existing turn-
around and lois el,~reCs in thc area. }!c advised he and his wife moved into the area in October,

Boar~l o1: Adjustment/May 6, 2004
