In[:. will soon appe~r before the City Council for final plat approval. Turtle Moon, <br />Inc. has entered into a Purchase Agreement with The Ryland Group, Inc. for the sale of most of <br />the residential property wittiin Ri venwick Fourth Addition. <br /> <br />As the plam~cr lbr the City of Rmn~y, I understand that you will be preparing the Development <br />Agreement ~br this plat. Both Turtle Moon, Inc. and The Ryland Group, Inc. propose that the <br />following langmuge be inserted ii, to the Development Agreement: <br /> <br />Any changes to the City's comprehensive plan or official controls from and after the <br />effective date of this Lano Development Agreement will not, without the consent of the <br />Developer for m~y particuim development site or for the entire Kivenwick Fourth <br />Addition project, apply to 'that development site or the entire RNenwick Fourth Addition <br />project, ~xcept to the exteat required by state, county, or federal law, or regulation or <br />order, or by order or judgment of a court with jurisdiction over the matter. The City and <br />the Developer agree, how,.:ver, that after an occupancy permit has been issued for a <br />building located on a lot within the developmem site, then the City, i£it determines th.at <br />such action is necessary t~ protect the health, safe~y, or welfare, may amend its official <br />comrols ~ks to such built o~it lot, <br /> <br /> <br />
