IT IS T~I~E;cO[~ BY A~D 8E'I'~.'E~ SAID P~TIES AS FOLLOWS: occurring in the _ Cl~ .... of ~a~ tn the area designated on Schedule A with at leant on~ (1) ptmpi~g engine and equipment to del~v~r at least 1,500 gallon~ of water and a.ch voTuntcer firemen as ~y be designated by the Chief of the E].k River Fire Depart:~nt, ,r his Deputy, unless in the Judge~nt of said Chief, or Deputy, such fire can be rouE, bt with other equipment ~intained by the CITY as part of its fire departmen~ , s~xbJect only to the limitations and restrictions hereinafter set ,forth: a. If road and we~ther c ~ndi~ions at the time of the call be ~uch that the fire ~uq cannot be ~.%de w. th ~:easonable ~afety to men and equipment, and the decision of the Fire Chic' or his Deputy in charge shall be final in such ~atLer, t~o obligation ari :e~; under this agree~nt on the part of the CITY b. In ~he event thac a ~ ~ffJcient ~o~nt of the fire fighting equtpmen~ and number of vo).unteer firemen, ox both, are co~itted at the time of the. fire c~iI, in th~ sole J~Jgement of the Chief or hie Deputy, to fighting pre--existing fire, $o as ::o ~ender the available fate fighting mqulpment and volunteer fiwemen in~4eq~)age to answer the fire call, in Ramsev and fight the reported fJ,;e, no obl. igation arises under this agrke~nt auswer such call, and no per,on or party shall have recourse agalnat the CITY for refusal to answer mmh caJ_l.
