A CONDITIONAL USB PEP~IT TO GI~DE AND <br />EXCAVATE TO CREATe' A NAN-MADE LAKE IN NORTHFO~K P.U.D.; <br /> CASE OF L & C REHBEIN, INC. <br /> B¥~ Anne Norris~ Community Development Director <br /> <br />Background: <br /> <br />L & G Rehbei~, Inc. ia requ.~nting a conditional use permit to grade and <br />excavate to crea~:e a second l~ke in the Northfork P.U.D. The proposed lake <br />will have approximately 40 acres of surface area and an average depth of 25 <br />feet. The lake is proposed to. b~ in the. western portion of the P.U.D., west of <br />A~drie Street NW and south ~f 161st Avenue NW. Ail hauling of excavated <br />materials will. b~ restricted to l{unicipal, County, and State Aid roads. The <br />developers have atated that i'~ will take several years to create the lake. <br /> <br />As you recall, Northfork P.U Do was required to complete an environmental <br />impact statement., This document made reference to the creation of a man-made <br />lake in the developmento Thi,~ satisfies the Environmental Quality Board's <br />requirements for an environmental assessment worksheet for the lake. <br /> <br />Enclosed are the following items for your information: <br /> <br />a) Applica~ion <br />b) Site location map <br />c) Letter dated March 3, 1987 from Mr. John Stine, DNR <br />d) Letter dated April 7~ 1987 from Mr. John Stine, DNR <br />e) Letter dated April 8, 1987 from City Engineer Raatikka <br /> f) Sketch ~nd memo from Police Chief Auspos regarding railroad crossing <br /> g) Proposed findings of fact <br /> h) Proposed conditional u~e permit <br /> <br />0bservations~ <br /> <br />The Planning and Zoning Commission conducted a public hearing on this request <br />on March 3, 1987o At that time, the Commission requested additional <br />information from the DNR an/~ City Engineer regarding the impact of this <br />proposal on Lake Itasca and water levels. In addition, the Commission <br />requested that the City Engin~er review what routes should be used to haul <br />excavated material~, l~te DNR and City Engineer have determined that the lake <br />as proposed will not have a:~ impact on Lake Itasca. The City Engineer <br />determined that i:he trucks sho~l.d use only State, County, or Municipal State <br />Zid streets for haul roads. <br /> <br />On April 7, 1987., the Commission recommended approval of this request provided <br />that a monitoring, well be inst-ali, ed to monitor water levels in Lake Itasca and <br />the new lake as ~pecified by tae DNR. The Commission also requested that the <br />railroad crossing at County Road 483 be reviewed with respect to long trucks <br />crossing the rai~(road tracks. The Commission also suggested that the City may <br />consider chargint~ a natural resource tax on the excavated material. Police <br />Chief Auspos and City Enginee~ Raatikka reviewed the railroad crossing and <br />determined that i:here is suffi~;ient room to accommodate the large trucks. <br /> <br /> <br />
