- 26 - <br /> <br />conveyed to Owners other than the Declarant. If the Association <br />prevails as to any relief sought in any action brought to enforce <br />complaince with this Article IX, it shall be entitled to recover <br />from the violation party reasonable attorney's fees and costs <br />incurred in connection with such legal action. The amount 9f-the <br />recovery and the attorney's fees and costs shall be a lien <br />against the Owner's Lot and a personal obligation of the Owner. <br />In addition, the Association shall have the right to restore any <br />part of the Property to its prior condition, if any alteration <br />was made in violation of this Article IX, and the cost of such <br />restoration shall be a personal obligation of the Owner causing <br />the violation and a lien against such Owner's Lot. <br /> <br /> ARTICLE X <br /> <br /> MA I NTE NAN(~ E <br /> <br /> Section 20.1 Exterior Maintenance. The Association shall <br />provide for the maintenance and repair of the Common Property. <br />Maintenance and repair shall be determined and implemented from <br />time to time by the Board of Directors at its sole discretion and <br />assessed against the Owners pursuant to Article VI of this <br />Declaration. <br /> <br /> Section 10.1 Damage by Owner. If, in the judgment of the <br />Board of Directors, the need for maintenance, repair or <br />replacement by the Association of any part of the Common Property <br />is caused by willful or negligent act of an Owner or Occupant or <br />their guests, the cost of such maintenance or repair may be added <br />to and become a part of the assessment to which such Owner and <br />his or her Lot are subject. <br /> <br /> <br />
