® <br /> <br />e <br /> <br />10. <br /> <br />The Developers agree to reimburse the City for all <br />costs incurred by the City iu defense or enforcement of <br />this Agreement, or any portion thereof, including court <br />costs and reasonable engineering and attorney's fees. <br /> <br />The minimum setbacks for lots in the plat shall be as <br />follows: <br /> <br />Setback from Dysprosium Street: 40 feet <br />Side yard setback for corner lot: 25 feet <br /> <br />If any portion, section, subsection, sentence, clause, <br />paragraph or phase of this contract is for any reason <br />held to be invalid by a court of competent jurisdiction, <br />such decisions shall not effect or'void any of the other <br />provisions of this Contract. <br /> <br />The Developers agree that this Development Agreement <br />shall be recorded in the office of the Anoka County <br />Recorder and agree that the terms and provisions of this <br />Agreement shall be a covenant imposed on each lot <br />included within the plat. <br /> <br />Notwithstanding the Developer's Agreement of <br />Partnership attached hereto as "Exhibit A", Elizabeth <br />Raudio and N.C. Inc. agree not to remove themselves as <br />partners from FLINTW00D VENTURE COMPANY or diminish <br />their respective ownership or interest in said <br />partnership without the prior written consent of the <br />Ramsey City Council. The purpose of this provision is <br />to insure the continuity of management and financial <br />responsibility of the Developers and their partners as <br />relates to the FLINTW00D HILLS 4TH ADDITION plat. <br /> <br />Elizabeth Raudio and Norman D. Holm, each as <br />individuals, hereby agree to personally guarantee and be <br />bound by each of the terms, obligations and commitments <br />undertaken by NC, Inc. and FLINTWOOD VENTURE COMPANY as <br />contained in this agreement. <br /> <br />11. (a) The term "Developers" as used herein refers to: <br /> <br />FLINTWOOD VENTURE COMPANY, a <br />Minnesota partnership consisting of: <br /> <br />NC, Inc., a Minnesota corpor'ation <br />Elizabeth Raudio, an individual <br /> <br />(b) The address of the Developers for the purpose of <br /> this Development Agreement is: <br /> <br />FLINTW00D VENTURE COMPA/~f <br />c/o Norman Holm <br />700 Industry Boulevard <br />Anoka, Minnesota 55303 <br /> <br /> <br />
