3. No legally impounded animal shall be released except to the person displaying a receipt from the city clerk showing payment in full of the costs of impounding and care of the animal. If any person, without authority of ]aw, and w~thout first paying the costs due, shall take any impounded animal out of the enclosure in which be is impounded, he shall be guilty of a misdemeanor. 4. Costs incurred by the city in impounding horses running at large shall be paid by the owner of the horse prior to releasing said an i ma ]. 5. If any horse impounded is not redeemed within fourteen " (14) days, the chief of police or his designated agent shall give an addJ. tional three (3) days notice of the time and place.where such animal or animals will be sold by posting and serving notices as required for notice herein. If such animal cannot be sold on the day stated, it may he sold as soon as possible thereafter without notice. 6. The city clerk shall turn over the proceeds of any sale to the city treasurer. On order of the city council, the city treasurer shall pay to the owner of such animal the difference between the sale price as stated in item 4, after deducting the cost of impounding, feed- ing and sales charges, if the owner makes claim for the monies within one (1) year from the date of the sale; otherwise, it shall be f~rfeited to the city. 7. No person may ride or drive a horse after the hour of sun- set and before the hour of sunrise along or crossing any public way without appropriate lighting or reflectorized cl0tbing. 8. No person may ride or drive a horse in any public park, beach, golf course or other public property except within the right-of- way of public streets and highways and in areas duly designated as a trail way or hitching area. 9. The city park and recreation commission shall designate and properly post those areas in public lands and parks where horses ~nay be ridden. ]0. Every person riding a horse or driving any horse-drawn vehicle upon a public roadway shall be subject to those provisions of the city code applicable to the driver of a motor vehicle, except those provisions which by their nature have no application. 11. No horse shall be ridden or driven in any manner which would cause undue damage to any hard-surfaced road. 12. No person shall ride or drive an), horse upon private property without the prior wirtten pez~ission of the owner or occupant thereof. 13. No person or domestic animal shall interfere with any horse ridden or kept in a lawful manner.
