PROPOSED FINDINGS OF FACT CONDITIONAL USE PERMIT MR. JIM FRANKLIN That Mr. Jim Franklin, hereinafter referred to as "Applicant", has properly applied for a conditional use permit to construct an advertising sign. That the Applicant appeared before the Ramsey Planning and Zoning Commission for a public hearing pursuant to Sections 170.01,3~ and 170.054 of the City Code on July 7, 1987 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as part of these findings by reference. 3. That the subject property is legally described as follows: Part of the Northeast Quarter of the Southwest Quarter of Section 28, Township 32, Range 25, Anoka County, Minnesota, described as follows: Beginning at the point of intersection of the West line of said Northeast Quarter of the Southwest Quarter with the Southerly right-of- way line of the Burlington Northern Railroad, then Southerly along said West line of said Northeast Quarter of the Southwest Quarter to its intersection with the Northerly right-of-way line of U.S. Trunk Highway #10 then Southeasterly along said Northerly right-of-way line of said Highway a distance of 485.0 feet to the actual point of beginning of tract tobe herein described then continuing along the northerly right-of-way line of said Highway 140 feet, then Northerly to a point on said Southerly right-of-way line of said Burlington Northern Railroad 691.80 feet Southeasterly from the West line of the Northeast Quarter of the Southwest Quarter as measured along the West line of the Burlington Northern Railroad 140 feet then Southwesterly to the point of beginning. Except road. Subject to easement of record. e That the subject property is located in the I-I Industrial District and is approximately .6 acres in size. That the Applicant is requesting a conditional use permit to construct an advertising sign on the subject property. e That Section 170.054 of the City Code requires that advertising signs shall be constructed either on the site of the subject activity or within 2500 feet of~the subject activity advertised On the sign. That Section 170.054 of the City Code also requires that all advertising signs shall require a conditional use permit prior to construction. 8. That the subject property is currently vacant and the Applicant plans to rent the subject property. 9. That the adjacent properties are located in the I-1 Industrial district. 10. That the proposed sign will not increase traffic into or from the subject property.
