10 Minutes CASE <br /> <br /> REQUEST FOR CONDITIONAL USE PERMIT TO SELL <br /> HANDCRAFTED ITEMS AND COLLECTIBLES FROM HOME; <br /> CASE OF MS. MARY ELLEN WALSH <br />By: Anne Norris, Community Development Director <br /> <br />Background: <br /> <br />Ms. Mary Ellen Walsh is requesting a conditional use permit to sell handcrafted <br />items and collectibles from her home at 15800 Nowthen Blvd. NW. Ms. Walsh's <br />property is located in the R-1R Rural Residential District and is approximately <br />8.5 acres in size. Retail sales is not a permitted use in any residential <br />district. <br /> <br />Enclosed are the following items for your information: <br /> <br />a) Application <br />b) Site location map <br />c) Proposed findings of fact <br />d) Proposed conditional use permit <br /> <br />Observations: <br /> <br />Section 170.015I of the City Code regarding home occupations states that <br />"...merchandise shall not be displayed or offered for sale, either within or <br />outside of the residence..." Also, the Code specifies that "...the operation <br />of any wholesale or retail business, unless conducted entirely by mail and does <br />not involve the sale, shipment or delivery of merchandise on the premises, is <br />pr ohib ired." <br /> <br />The Planning and Zoning Commission conducted a public hearing on this request <br />on July 7, 1987 and recommended approval of Ms. Walsh's request. <br /> <br />Recommendation: <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Findings of Fact 00__ <br />conditional use permit. <br /> <br />relating to Ms. Walsh's request for a <br /> <br />-and- <br /> <br />Motion to: <br />Approve/deny Ms. Walsh's request for a conditional use permit to sell <br />handcrafted items and collectibles from her property. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Planning and Zoning Commission <br /> <br /> <br />
