30 Minutes CASE #6: <br /> <br />DISCUSS CONDITIONAL USE PEP~IT FOR <br /> GRADING AND EXCAVATING; <br /> CASE OF MR. GILBERT MENKYELD <br /> By~ Pete Raatikka, City Engineer <br /> <br />Background: <br /> <br />On July 7, 1987, the City Council directed me to have the organic material <br />which had been disposed of on the Menkveld property south of 149th Avenue NW <br />removed. ,' <br /> <br />On July 8, 1987, I sent Mr. Art Raudio, agent for Mr. Gilbert Menkveld, a <br />letter requesting him to remove all material unsuitable for building which had <br />been placed in areas of existing granular soils. On July 10, 1987, I met with <br />City Administrator Hartley, City Attorney Goodrich, Mr. Art Raudio, Mr. Norm <br />Holm, and Mr. Steve Munstenteiger, attorney for Mr. Raudio and Mr. Holm, in an <br />attempt to resolve the problem of importing and burying topsoil and organic <br />material on the grading site. Mr. Raudio and Mr. Holm agreed not to bury any <br />additional material on the site but they asked for a permit to import and <br />stockpile topsoil. Details of that permit were established and the permit was <br />issued following that meeting. <br /> <br />The unresolved issue remaining is the material which was disposed of on the <br />back portion of the proposed industrial lots. Mr. Holm and Mr. Raudio stated <br />that they improved the front half of the lots to contain 50% Class I soils <br />utilizing a portion of the good material from the back of the lots. They also <br />stated that they have complied with the grading plan since they are filling the <br />back portion of the lots to final grade with organic soils. <br /> <br />Enclosed for your information are my two letters of July 8, 1987 to Mr. Art <br />Raudio, a letter dated July 10, 1987 from Mr. Norm Holm addressed to myself, <br />and a copy of the permit for importing and stockpiling topsoil. In addition, <br />we have drilled and surveyed the site to determine the limits of the organic <br />soils. A map showing the location of those soils will be available at the <br />meeting. <br /> <br />Recommendation: <br /> <br />Based on the following reasons, I would recommend that the past action of the <br />City Council directing removal of the imported organic soils placed below final <br />grade and not used for topsoil be upheld: <br /> <br />1) At no time did the permit holder ask to import material to be buried <br /> on the back of the proposed lots. <br /> <br />2) <br /> <br />On the morning of July 7, 1987, Mr. Raudio asked me if he could bring <br />import organic material to be used for a topsoil. Later that day, <br />observed that organic material was being buried on the grading site. <br />Soil borings indicate that up to eight feet of poor soils have been <br />placed below the proposed final grades. <br /> <br />3) <br /> <br />Mr. Raudio has stated that the organic material was placed on the back <br />side of the proposed lots and there is at least 50% Class I soil left <br />on the lots for development. City Code states that all lots in <br />unsewered areas contain at least 25% Class I soils. Twenty-five <br />percent Class I soils may be adequate for residential development with <br /> <br /> <br />
