We reviewed several matters related to <br />protected waters and wetlands, as follows: <br />1) The construction of a driveway along the common property line of <br />Lots 9 and 10 of the subject development where approximately 15 <br />feet of fill either side of the property line would be placed for <br />a driveway would not require a DNR permit. This would avoid the <br />need for realigning property lines; however easements or other <br />legal means of providing access were also discussed. <br />2) The small wetland most southerly on Lot 10 is not contiguous with <br />protected wetland 2-728W at its ordinary high water mark (OHW). <br />Mr. Raudio presented information which demonstrated that the <br />connection between the two wetlands was above elevation 867.5 <br />feet. I previously had identified that wetland as part of <br />P2-728W. <br />3) Excavation of a ditch to convey water from protected wetland <br />2-728W to the south ultimately to 2-671W would require a permit <br />from the DNR pursuant to Minnesota Statutes §105.42. The <br />application for such a permit should be coordinated by the city <br />as the work would constitute a water level control structure for <br />the wetland. Outlet elevations are dictated by the Department's <br />Pules Part 6115.0221, Item C for landlocked basins within a <br />single municipality (see enclosed copy). <br />AN EQUAL OPPORTUNITY EMPLOYER 4 <br />
