- 23 - <br />until the plans and specifications showing the nature, kind, <br />shape, height, color, materials and locations of the same shall <br />have been approved in writing as to harmony of external design, <br />color, size and location in relation to surrounding structures <br />and topography by the Board of Directors, or by a Design Review <br />Committee composed of three or more Owners appointed by the Board <br />of Directors (referred to herein as the "Reviewing Authority"). <br />Section 9.2 Review of Proposed Alterations/Remedies for <br />Violations. Detailed plans and specifications of any proposed <br />alteration, in form acceptable to the Reviewing Authority shall <br />be submitted to the Reviewing Authority for approval prior to the <br />projected commencement of construction, and no alteration or <br />construction shall be commenced prior to such approval. In the <br />event the Reviewing Authority fails to approve or disapprove such <br />design and location within thirty-five (35) days after said plans <br />and specifications have been submitted, then approval will not be <br />required, and this Article shall be deemed to have been fully <br />complied with so long as the alterations or improvements are done <br />in accordance with the plans and specifications submitted. Not- <br />withstanding the foregoing, the Board of Directors retains the <br />right to submit any request to the members of the Association at <br />a Special meeting called pursuant to the Bylaws. Such meeting <br />shall be called within thirty-five (35) days from receiving the <br />request in accordance with this Article, in which case the 35 day <br />review period shall be extended until three (3) days following <br />such meeting.
