ESTES PAR$1NEN & LEVY

Ramsey City Council
August 13, 1987
Page 2

It has now come to our clients' attention, pursuant to discussions at the most recent
City Council meeting of August 11, 1987, that the City no longer is prepared to proceed
with the development of the public works facility on a site located within our clients'
property. In addition to the extreme difficulties which our clients have encountered in
negotiating with the City regarding the excavation, grading and stockpiling on the
subject parcels, please be advised that OUR CLIENTS HEREBY WITHDRAW ANY AND
ALL OFFERS TO PERMIT THE CITY TO VOLUNTARILY PURCHASE ANY PORTION
OF THE SUBJECT PROPERTY. It is our clients' intention to proceed with the
development of the subject property, consistent with the ordinances of your municipality
and seek plat approval and other approvals necessary to proceed with the development of
the subject property.

It is our understanding that a portion of the subject property may be affected by a
proposed expansion of the existing municipal airport. According to our information, the
approvals have not yet been given from the applicable agencies and, even if given, the
projected timetable does not call for construction until late 1989. Under these
circumstances, our clients will proceed with due regard to the possibility of the airport
expansion, but will not be delayed in their development plans by future events which may
or may not occur. In any event, the development of the subject parcel, subject to the
future constraints from the expansion of the airport, should not in any way affect our
clients' compliance with the requirements of your ordinances.

Our clients will appear before the City Council meeting on Tuesday, August 18,
1987. This letter is written for the purpose of distribution to the members of the City
Council, the City Engineer and other interested parties prior to that date. It is intended
that this letter will set forth the position of our clients at that meeting and constitute
notice to you of their intentions.

Very truly yours,

Richard I.
