CC Regular Session 4. 9. <br />Meeting Date: 06/28/2016 <br />By: Chris Anderson, Community <br />Development <br />Information <br />Title <br />Adopt Resolution #16-06-123 Approving the Development Agreement for Brookfield 7th Addition; Case of <br />Brookfield Land, LLC <br />Purpose/Background: <br />On May 24, 2016, the City Council granted Final Plat approval for Brookfield 7th Addition, contingent upon, <br />among other things, the Developer entering into a Development Agreement with the City. At the time of plat <br />approval, a detailed cost estimate for the Stage I Required Improvements was not available and thus, the <br />Development Agreement included with that case was only in draft format. The Developer has since submitted a <br />cost estimate for the Required Improvements that has been reviewed and found sufficient by City Staff. This is <br />important as it is the basis for establishing the surety and inspection fee components of the Development <br />Agreement. <br />Notification: <br />Notification is not required for approving a Development Agreement. <br />Observations/Alternatives: <br />Brookfield 7th Addition consists of twenty-seven (27) single family residential lots. This is the final phase of the <br />previously approved Preliminary Plat. This phase will include the construction of 167th Crossing, 167th Lane, and <br />Kamacite St as well as installation of municipal water, sanitary sewer and storm sewer utilities. The Required <br />Improvements are outlined in the attached Development Agreement. Staff continues to work with the Developer <br />regarding necessary plan revisions before the Final Plat will be released for recording. <br />Funding Source: <br />All costs associated with processing the request are the responsibility of the Applicant. <br />Recommendation: <br />Staff recommends adopting Resolution #16-06-123 approving the Development Agreement for Brookfield 7th <br />Addition, subject to review by the City Attorney as to legal form. <br />Action: <br />Motion to adopt Resolution #16-06-123 approving the Development Agreement for Brookfield 7th Addition, <br />subject to review by the City Attorney as to legal form. <br />Attachments <br />Site Location Map <br />Final Plat <br />Development Agreement <br />Resolution #16-06-123 <br />
