Density transitioning landscaping <br />(the "Stage I Improvements"). <br />The PERMITTEE agrees to construct the Stage I Improvements according to the <br />terms and conditions of this Agreement and in accordance with the Plans and the <br />City Code. Per City Code Section 117-615, the PERMITTEE shall provide the <br />CITY with a set of re -producible as -built plans in Computer Aided Drafting (CAD) <br />format upon completion of the Stage I Improvements and acceptance by the CITY. <br />As as -built plans are a required Stage I Improvement item per City Code Section <br />117-615, the CITY will not release the required Stage I Improvement Financial <br />Guarantee noted in Section 6 below until said as -built plans are provided to the <br />CITY. Additionally, the PERMITTEE agrees to provide to the CITY the plans in <br />CAD format prior to the commencement of construction of the Stage I <br />Improvements. <br />4. Maintenance Guarantee for Landscaping. It is herein agreed that the <br />PERMITTEE shall provide a maintenance guarantee to ensure the survival of the <br />Density Transitioning plantings. Said maintenance guarantee shall consist of cash <br />or an irrevocable letter of credit, approved as to form by the CITY, in the amount of <br />One Thousand Eighty Dollars and No Cents (1,080.00) [# plantings (12 trees) x <br />cost/planting ($300/tree) x 30% average non -survival rate], which shall be in effect <br />until a Certificate of Occupancy is issued for Lot 5, Block 4 and Lot 1, Block 2. <br />The Stage I Improvement Financial Guarantee described in Paragraph #6 below <br />may be utilized as the maintenance guarantee for landscaping. The PERMITTEE <br />agrees that the Stage I Improvement Financial Guarantee shall not be fully released <br />until this condition is satisfied. <br />5. Additional Requirements Related to Certain Stage I Improvements. The <br />PERMITTEE shall be required to commence a pre -construction meeting held at <br />the CITY offices. The PERMITTEE shall be responsible for contacting the CITY <br />to schedule said pre -construction meeting. The CITY will contact all utilities listed <br />2 <br />
