Notices shall be deemed to have <br />been duly given on the date of service if served personally on the party to whom <br />notice is to be given, or on the third day after mailing if mailed as provided above; <br />provided, that a notice not given as provided above is, if it is in writing, deemed <br />given if and when actually received by a party. <br />Storm Sewer Phasing Plan Exhibit. "Storm Sewer Phasing Plan Exhibit" means <br />the Storm Sewer Phasing Plan described in Section 10.1 and attached as Exhibit <br />K. <br />(dd) Master Agreement. "Master Agreement" means this agreement as the same may <br />be from time to time modified, amended or supplemented. <br />(ee) Master Development Plan. "Master Development Plan" consists of the Final Plat <br />and Engineering submittal, drafted by Polaris Group, Close Landscape <br />Architecture, Glenn Rehbein Companies and URS, last revised August 27, 2003, <br />showing the development concept uses, densities, acreages, street pattern and <br />future subdivision plan for the Subject Property. The term "Master Development <br />Plan" also includes any additions or changes to the various components of the <br />Master Development Plan the Council subsequently approves pursuant to the <br />RTC Ordinance. <br />(ff) <br />Master Final Plat. "Master Final Plat" means the plat of Ramsey Town Center <br />Addition which will be based on the Preliminary Plat the Council approved on <br />August 12, 2003. <br />(gg) Master Grading Plan. "Master Grading Plan" means Sheets 19-47 of the Master <br />Development Plan. <br />(hh) Memorandum of Understanding. "Memorandum of Understanding" means that <br />certain letter agreement between the City and the Developer, dated April 11, <br />2003. <br />(ii) Other Regulatory Agencies. "Other Regulatory Agencies" means and includes, <br />jointly and severally, the following: <br />(i) Minnesota Department of Transportation ("MnDOT"); <br />(ii) the County; <br />(iii) State of Minnesota; <br />1555730v13 6 <br />
