3. Conditions of Approval. The CITY hereby approves the Plat on condition that: a. the DEVELOPER enter into this Agreement, and b. the DEVELOPER provide the necessary security in accordance with the terms of this Agreement. 4. Development Plans. The DEVELOPER shall develop the Plat in accordance with the following plans. The plans shall not be attached to this Agreement, but are in CITY files. The plans may be prepared by the DEVELOPER, subject to CITY approval, after entering into this Agreement but before commencement of any work in the Plat. if the plans vary from the written terms of the contract, the written terms shall control The required plans are: Plan A - Final Plat (dated March 25, 2004 subject to revisions per City Staff Review Letters dated April 15, 2004 and April 23, 2004) Plan B — Street, Utilitiies, Grading and Drainage Plan (dated March 25, 2004 subject to revisions per City Staff Review Letters dated April 15, 2004 and April 23, 2004) Plan C - Landscape Plan (dated March 25, 2004 subject to revisions per City Staff Review Letters dated April 15, 2004 and April 23, 2004) 5. Stage I Improvements Required. The improvements the CITY requires the DEVELOPER to construct within the Plat are as follows: a. Trunk and lateral sanitary sewer system b. Trunk and lateral watermains and appurtenances c. Public streets with concrete curb and gutter d. Private streets with concrete curb and gutter e. Trunk and lateral storm drainage facilities f. Lot grading and permanent erosion control g. Landscaping h. Trail Construction along Ramsey Blvd. i. Sidewalk Construction along Peridot St. NW, Olivine St. NW, and 146th Ave. NW j. Natural gas k. Telephone service 1. Electric service m. Street lights (installment arranged by the CITY during Stage I Improvements and paid for by DEVELOPER as Stage II Improvement) ("Stage I Improvements") Ramsey Town Center 2"d Addition Development Contract Page 2 of 13 Pages
