Skeim, the developer for the above plat states
that he had Planning Commission approval on the restrictive
covenants for the subject ~la% which permitted the building
of accessory buildings of a minimum square footage of 320
s&uare feet. Now, the Public Hearing notes the discussion
of restrictive covenants for Traprock Commons. However, the
Planning Commission resolution makes no reference to the re-
strictive covenants. Secondly, the City Council in their
action on aDDrovin~ the ~lat did not even know about a
covenant.

Consequently, we have the Council declarin~ a moratorium on
accessory buildinKs and then we have Mr. Skiem sa.vin~ he has
been eranted a restrictive covenants with the subject ~lat
which allows accessory buildings. Thirdly, we have a covenant
which has been first drawn up during the month of SeDtember,
1978.
