PROPOSED FINDINGS OF FACT <br /> MX. BILL DULATS <br /> <br />I. That Mr. Bill bubgts, hereinafter referred to as "Applicant", has <br />properly applied for a conditional use permit to construct a self-service <br />storage facility in the B-1 Business District. <br /> <br />2. That the Applica:.t appeared before the Planning and Zoning Commission <br />for a public hearing pursuant to Section 170.013D of the City Code on <br />November 3, 1987 and that said public hearing was properly advertised and <br />that the minutes of that public hegring are hereby incorporated by <br />reference. <br /> <br />3. That the subject property is generally known as 13820-Ebony Street N.W. <br /> and is legally described as follows: <br /> <br />Lot 1, Block 3, Riverside West, Anoka County, Minnesota <br /> <br />4. That the ~ubject property is approximately 1.33 acres in size. <br /> <br />5. That the subject property is located in the B-i Business District and <br />is also located in the Critical River Overlay District. <br /> <br />6. That the Applicant is proposing to construct a self-service storage <br />facility which will consist of three buildings totalling approximately <br />18,400 square feet. <br /> <br />7. That a storage facility is not a permitted use in the B-I Business <br />District. <br /> <br />8. That the adjacent properties are also located in the B-i Business <br />District. <br /> <br />9. That immediately to the south of the subject property on Lot 2, Block <br />3, Riverside West, the Applicant applied for and obtained a conditional use <br />permit in 1986 to operate a self-service storage facility. <br /> <br />10. ~aat John Stine of the DNR has reviewed the Applicant's request and has <br />no objections to the proposed use. <br /> <br />11. That the proposed use will increase traffic into and from the subject <br />property. <br /> <br />12. ~nat the proposed use will not be unduly dangerous or detrimental to <br />the general welfare. <br /> <br />13. That the proposed use will not subs=antiai!y adversely impair the use <br />or enjoyment of adjacent properties. <br /> <br />14. That the proposed use will be designed, constructed and maintained so <br />as to be harmonious and appropriate in appearance with the intended <br />character of the B-1 Business District. <br /> <br />15. That the proposed use will not change the essential character of the B- <br />I Business District. <br /> <br /> <br />
