prescribed by this subsection or shall make, willfully or otherwise, an incorrect, false or fraudulent return, such operator, upon ~itten notice and demand, shall immediately file such return or corrected return and at the time pay any fee due on the basis thereof. If such operator shall fail to file such return or corrected return, the City may make for him a return, corrected return, from its knowledge and from such information as the City can obtain through testimony or otherwise and assess a fee on the basis thereof, which fee (less any partial payments for the. fee covered by such return) shall be immediately paid upon written notice and demand. Any such return or assessment made by the City shall be prima facie correct and valid and such operator shall have the burden of establishing its incorrectness or invalidity in any action or proceeding in respect thereto. Nothing in this paragraph shall preclude the City of Ramsey from enforcing this subsection by pursuing any other remedy authorized by law or ordinance. Records. Every operator of a sanitary landfill in ~hich mixed municipal solid waste is accepted and disposed of shall keep adequate and complete records showing the total cubic yards of solid waste accepted and disposed of at the facility for each day. Examination of Records. ~ne City or its designated agent shall h~ve the right to examine records and accounts of the operator required to file a return. 130.10-3 USE OF REVENI/ES. Ine revenues from the fee collected by the City pursuant to this chapter shall be credited to the City's general fund and be used only for purposes of landfill abatement, or for purposes of mitigating and compensating for the local risks, costs, and other adverse effects of mixed municipal solid waste facilities. SECTION 2 EFFECTIVE DATE. This Ordinance shall become == + e~ec~ive 30 days after its publication subject to Ramsey City Charter Section 5.07.
