present to explain the basis on which is appraisal was formulated. <br /> <br />Case ~6: Easement Acquisition For Industrial Sewer Parcels In Riverside <br /> West And Parcels East Of Sunfish Lake Boulevard (Continued); <br /> <br />City Engineer Raatikka stated that Mn/DoT approval of the plans has been <br />obtained; the proposed resolution would authorize the City Attorney to <br />obtain easements through negotiations or condemnation. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to <br />table this case until a determination has been made regarding sewer and <br />water alignment and easements south of U.S. Hwy. #10 (Phase II of <br />industrial sewer and water project). <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, <br />DeLuca and Pearson. Voting No: None. Absent: Councilmember Cox was <br />temporarily out of Council Chambers. <br /> <br />Case ~7: Trunk Stor~ Sewer Improvement Pro~ect ~87-21: <br /> <br />City Engineer Raatikka stated that the project is for trunk storm sewer <br />from the north side of the Burlington Northern Railroad to the Mississippi <br />River; the city must apply for a permit to locate storm sewer in the <br />Burlington right-of-way and it will cost $500 for the first 5 year period <br />and $375 for each subsequent 5 year period. <br /> <br />Councilmember Cox noted that Cry. Rd. ~83 and ~.~63 are quickly deteriorating <br />because of traffic patterns resulting from Burlington's dictates on <br />railroad crossings; unfair of Burlington to require right-of-way payments <br />to fix drainage problems that their railroad beds contribute to. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson to <br />request that Burlington Northern Railroad waive the right-of-way permit <br />fees. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />Discussion ensued regarding whether or not the project should proceed in <br />full or a portion thereof that will still qualify for Mn/Dot matching <br />funds. Council determined that whether or not the project proceeds in <br />full at this time, the acquisition of right-of-way is necessary. <br /> <br />Motion b~ Councilmember DeLuca and seconded by Councilmember Sorteberg to <br />authorize the City Attorney to acqui=e the right-of-way for the trunk storm <br />sewer project ~87-21 in accordance with Mn/DoT requirements. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />Case f~Q <br /> ,~: Review Reouest For Tax Increment Assistance: <br /> <br />Mr. Eartley presented Council with copies of a draft agreement between the <br />City and G. Greg Wi!ley and Chateau Construction to use tax increment <br />financing providing the proposed projects are feasible.
