CA~SE ~1 ~ <br /> <br />REQUEST FOR CONDITIONAL USE PERMIT TO ESTABLISH A BITUHINOUS <br /> ASPHALT PLANT IN THE I-1 INDUSTRIAL DISTRICT; <br /> CASE OF COMHERCIAL ASPHALT COHPANY <br /> By: Community Development Director Anne Norris <br /> <br />Background: <br /> <br />Commercial Asphalt Company is requesting a conditional use permit to <br />establish a commercial asphalt bituminous plant on the southeast 20 acres <br />of the old Prestressed Concrete property. Access to the site would be from <br />County Road 116 and Highway 10. This property is located in the I-1 <br />Industrial district. <br /> <br />For your information, enclosed are the following items: <br /> <br />a) Application <br />b) Site location map <br />c) Proposed site plan <br />d) Letter dated August 24, 1987 from Joseph and Mary Jo Sentyrz <br />e) Proposed findings of fact <br /> <br />Observations: <br /> <br />The Planning Commission conducted a public hearing on this request on <br />September 1, 1987. At that time, the Commission tabled action on this <br />request pending: i) review of the application by the City Engineer; 2) <br />review of the application by the Airport Commission; and 3) determination <br />by the City Attorney as to the legality of the hearing and request as an <br />incorrect corporate name was used in the hearing notice. <br /> <br />The City Attorney determined that the incorrect corporate name on the <br />hearing notice will not impact the request. The Airport Commission <br />reviewed the request and had the following comments: 1) Will the <br />operation of an asphalt plant so near the airport create a safety hazard, <br />particularly with respect to visibility; 2) The proposed site is within <br />the boundaries of that area proposed for airport acquisition; and 3) <br />Commercial Asphalt Company should request FAA review for potential airspace <br />impact and approval. <br /> <br />The City Engineer's comments on this request will be available at the <br />meeting. <br /> <br />Recommendation: <br /> <br />The Commission may wish to table action on this request until Commercial <br />Asphalt Company has received comments from the FAA. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney X <br />Engineer X <br />Community Development Director X <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Airport Commission <br /> <br />X <br /> <br /> <br />
