-7- <br /> <br />application would not result in any detrimental efJects as per the <br />criteria listed above. <br /> <br />Subdivision 6. Conditions of Approval. In approving an application <br />for a wild animal license~ the City may attach conditions and restric- <br />tions as it finds necessary, including but not limited to the following: <br /> <br />Restrictions on the number and type of animals. <br /> <br />Setbacks greater than those required in 110.183, Subd. 2. <br /> <br />C. Minimum and/or maximum distance between primary' and <br />secondary enclosures. <br /> <br />Minimum height of enclosures. <br /> <br />Size of the enclosures. <br /> <br />Subdivision 7. Expiration. The wild animal license shall expire twelve <br />months from the date of issuance. <br /> <br />Subdivision 8. Renewal of License. Application for renewal of a <br />wild animal license with any changes shah be made a minimum of <br />19 days before the next regularly scheduled Planning Commission <br />meeting. Application for renewal with no changes shall be made 14 <br />days before the next regularly scheduled City Council meeting provid- <br />ing that the public hearing and review before the Planning Commission <br />has been waived. The City may require an inspection upon renewal <br />of a wild animal license and shall reserve the right to have said inspec- <br />tion performed by an approved qualified consultant. <br /> <br />I10.185 VARIANCES. <br /> <br />Subdivision 1. Variance and Review Criteria. Where the City £inds <br />that extraordinary hardships or practical dif£iculties may result from <br />strict compliance with the provisions of this ordinance~ and the pur- <br />poses of this ordinance may be served 'co the same or greater extent <br />by an alternative proposal, the City may approve variances to this <br />ordinance so that substantial justice may be done and the public inter- <br />est secured~ provided thaz: (1) such a variance shall not have the <br />effect of nu!lifying the in*~e.nt and purpose of this ordinance and (2) <br />the City shall not approve variances unless, based upon the evidence <br />presented te it~ it finds that: <br /> <br />A. The granting of the variance would not be detrimental to <br />the public sa~et),~ health, or we]fare or injurious to property. <br /> <br />B. The conditions which a variance would be based upon are <br />unique to that application for which the variance is sought and are <br /> <br /> <br />
