CASE ~1: REQUEST FOR CONDITIONAL USE PERMIT TO EXTRACT AGGREGATES IN THE I-1 INDUSTRIAL DISTRICT; CASE OF BARTON SAND AND GRAVEL By: Community Development Director Anne Norris Background: Barton Sand and Gravel Company is requesting a conditional use permit to extract aggregates from the western 38 acres of the 78 acre parcel located north of County Road ~116, east of Ramsey Boulevard NW, and south of 149th Avenue NW. The eastern portion of the property is marshy and contains a protected wetland. The proposed plan shows access to the site from both County Road #116 and Ramsey Boulevard NW. Barton is proposing to excavate the site down to a minimum of six feet above the water table so that the site is suitable for future industrial development. Mr. Gary Sauer, President of Barton, has stated that the excavation will occur over several years. For your information, enclosed are the following items: a) Site location map b) Application and information packet c) Letter dated March 17, 1987 from Merland Otto d) Letter dated March 30, 1987 from Mr. John Stine, DNR e) Proposed findings of fact f) Proposed conditional use permit Observations: The subject property is located in the I-1 Industrial District. However, residential development abutts the property along the northern border. The extraction of aggregates, while it may be noisy and disruptive, would be temporary in nature and would not be permanently detrimental to the residential area. As you recall, Barton's request originally included the establishment of a bituminous asphalt plant on the site after excavation was complete. Barton has found a new proposed site for this operation (the southeast portion of the old Prestressed site) and is now only requesting a conditional use permit to excavate aggregates. Recommendation: Commission Action: Motion to: Recommend adoption of findings of fact relating to Barton Sand and Gravel Company's request for a conditional use permit. -and-
