29 LOCAL STATE-AID ROUTE STANDARDS,FINANCING 8820.4070 <br /> 8820.4040 NATURAL PRESERVATION ROUTE CONSIDERATION. <br /> Subpart 1. Commissioner approval or denial. Following receipt of the formal re- <br /> quest, the commissioner shall approve or deny the request to designate the roadway as a <br /> natural preservation route. The commissioner shall base the decision on the criteria in sub- <br /> part 2 and shall notify the political subdivision in writing of the decision. If the request is <br /> denied, a written explanation will be included with this notification. <br /> Subp. 2. Factors considered. The commissioner shall consider: <br /> A. the economic, social, safety, and environmental impacts that may result from <br /> the designation or denial of the designation; <br /> B. the magnitude of the effects on adjacent lands and the value of the character- <br /> istics identified in part 8820.4020, subpart 2, <br /> C. the number of persons,either residents or the traveling public,affected by des- <br /> ignation or denial of designation; <br /> D. the present and future use of adjacent lands; <br /> E. safety considerations as they apply to pedestrians;bicyclists;the motoring pub- <br /> lic; and fire,police, and emergency units; and <br /> F. other related issues as may be pertinent to the roadway that have been identified <br /> from information submitted in part 8820.4020, subpart 2. <br /> Statutory Authority: MS s 162.02; 162.021; 162.09 <br /> History: 18 SR 32; 32 SR 608 <br /> 8820.4050 NATURAL PRESERVATION ROUTE STATE AID. <br /> The extent of state aid participation for a construction project must be determined on <br /> the same basis as a regular county state-aid highway project,except that landscaping items <br /> are eligible for up to two percent of the total construction allocation of the year in which any <br /> construction on the natural preservation route is completed. This amount for landscaping <br /> is in addition to the amount allowed in part 8820.3 100, subpart 10. <br /> Statutory Authority: MSs 162.02; 162.021; 162.09 <br /> History: 18 SR 32; 20 SR 1041 <br /> 8820.4060 NATURAL PRESERVATION ROUTE DESIGN STANDARDS. <br /> The standards in parts 88209980 and 8820.9986 apply to designated natural preserva- <br /> tion routes. In the case of reconstruction,the designer shall preserve,to the greatest extent <br /> possible,the existing profile, alignment, and cross section. In doing so,the designer shall <br /> consider the use of guardrails,retaining walls, and curb sections to protect natural ameni- <br /> ties. To the extent practical,the designer shall include in the design landscaping,including <br /> native species, curving alignments, variable back slopes, variable ditch bottoms, limited <br /> clearing, and other means available to limit the impacts on the environment while still ad- <br /> dressing public safety. <br /> Statutory Authority: MSs 162.02; 162.021; 162.09 <br /> History: 18 SR 32; 20 SR 1041 <br /> 8820.4070 NATURAL PRESERVATION ROUTE RECONSTRUCTION. <br /> A county proposing a project that requires removal of the entire surface of a county <br /> state-aid highway that is a natural preservation route shall send to owners of property abut- <br /> ting the highway a written notice that describes the project. In addition, the county shall <br /> hold a public meeting to discuss design and construction alternatives. Before project ap- <br /> proval,the county highway engineer shall provide evidence to the state aid engineer that the <br /> concerns raised at the public meeting have been addressed or incorporated into the project. <br />
