Counci hnember Kurak questioned if holding a fund would be legal. <br /> <br />City Administrator Norman replied the HRA could levy and save the funds. <br /> <br />Councilmember Kurak inquired about the HRA being able to sue and be sued. <br /> <br />City Administrator Norman explained this is the same exposure the City has. He noted he was <br />proposing to put this in place before the budget, and if this is not completed by July there would <br />bo at timing issue. He explained there is already a commitment to pay off the industrial parcels <br />that were purchased. If an HRA were to be formed the function of the EDA would not change. <br />Thc EDA would work with industrial properties and the HRA would work with housing. <br /> <br />Staff was directed to put together a flow chart for the Council to review, an explanation of timing <br />issues, and a suggested levy amount. <br /> <br />City Administrator Norman clarified the HRA would not only be for financial reasons, the <br />greater reason is that there is a purpose for an HRA. <br /> <br />Councihnember Elvig noted the HRA would be able to draw federal funds to move houses <br />arotmd and put them in small neighborhoods, which is the only way to get affordable housing <br />anymore. <br /> <br />City Administrator Norman indicated he xvill bring this item back to the Council. <br /> <br />4) 7:00 a.m. Construction Start Time <br /> <br />Police Chief Way explained that direction is needed from the Council regarding start times for <br />construction projects. Since 2000 the City has received 34 complaints. One individual is <br />contacting the police on a regular basis with complaints of projects 1 ½ miles from his house. <br />This individual contacts the police when there is a truck backing up and beeping before the start <br />time. In this type of situation the truck is back on Highway 10 before a staff member can get to <br />the site. <br /> <br />City Administrator stated this individual has turned in a petition to enforce the 7 a.m. <br />construction time. He stated the way the ordinance is written there is need for discretion and <br />flexibility lot' a project like Alpine Acres that is quite a distance. He just received a request today <br />to let them start their trucks and idle for ten minutes. <br /> <br />Counci hnember Kurak inquired about the signs that were discussed to be posted by construction <br />sites with the start time. She stated the subcontractors probably do not have a copy of the City <br />ordinance, and the sign would inform them of the start time. <br /> <br />The consensus of the Council was to adhere to the 7:00 start time, except under extenuating <br />circumstances, such as extreme weather, as stated in the ordinance; and that staff notify the <br />Cotmcil in weekly updates. <br /> <br />City Council Work Session/April 13, 2004 <br /> Page 5 of 6 <br /> <br /> <br />
