Staff has conducted research on local communities with ordinances regulating transient merchant <br />sales and has provided these examples. Additionally, Staff reviewed existing regulations that are <br />similar in nature, but do not directly apply to the use in discussion. These regulations include <br />Interim Use Permits, and the provision of temporary seasonal sales as an accessory use in certain <br />districts. Temporary seasonal sales are, however, neither defined nor regulated beyond being <br />permitted as an accessory use in B-2, H-1. Staff requested comment from the Commission on <br />how to proceed. <br />Commission Business <br />Acting Chairperson VanScoy asked if there are issues now with the current policy. <br />Community Development Intern Meyers stated that the current policy is very barebones and <br />provided details. <br />Community Development Director Gladhill stated that there is not an issue that has been <br />identified but noted that there has been an increased activity and therefore staff wanted to review <br />the issue to check the temperature of the Commission. <br />Commissioner Brauer asked if he could put up on a tent on property within The COR and sell <br />any legal merchandise for up to 60 days. <br />Community Development Intern Meyers confirmed that is true. <br />Community Development Director Gladhill noted that the activity is only allowed on <br />commercial/retail space on a parking surface. <br />Acting Chairperson VanScoy asked if the farmers market is considered under this policy. <br />Community Development Director Gladhill stated that is governed under a special event permit. <br />Community Development Intern Meyers confirmed that there were no complaints received in the <br />past 90 days. <br />Community Development Director Gladhill stated that the City received complaints regarding <br />transient merchants along Highway 10 in the past. <br />Commissioner Maul suggested tabling the issue until there is a more serious complaint. <br />Acting Chairperson VanScoy agreed that changes should not be made to something that is not <br />broken. <br />Planning Commission/July 21, 2016 <br />Page 19 of 20 <br />
