Staff has conducted research on local communities with ordinances regulating transient merchant
sales and has provided these examples. Additionally, Staff reviewed existing regulations that are
similar in nature, but do not directly apply to the use in discussion. These regulations include
Interim Use Permits, and the provision of temporary seasonal sales as an accessory use in certain
districts. Temporary seasonal sales are, however, neither defined nor regulated beyond being
permitted as an accessory use in B-2, H-1. Staff requested comment from the Commission on
how to proceed.
Commission Business
Acting Chairperson VanScoy asked if there are issues now with the current policy.
Community Development Intern Meyers stated that the current policy is very barebones and
provided details.
Community Development Director Gladhill stated that there is not an issue that has been
identified but noted that there has been an increased activity and therefore staff wanted to review
the issue to check the temperature of the Commission.
Commissioner Brauer asked if he could put up on a tent on property within The COR and sell
any legal merchandise for up to 60 days.
Community Development Intern Meyers confirmed that is true.
Community Development Director Gladhill noted that the activity is only allowed on
commercial/retail space on a parking surface.
Acting Chairperson VanScoy asked if the farmers market is considered under this policy.
Community Development Director Gladhill stated that is governed under a special event permit.
Community Development Intern Meyers confirmed that there were no complaints received in the
past 90 days.
Community Development Director Gladhill stated that the City received complaints regarding
transient merchants along Highway 10 in the past.
Commissioner Maul suggested tabling the issue until there is a more serious complaint.
Acting Chairperson VanScoy agreed that changes should not be made to something that is not
broken.
Planning Commission/July 21, 2016
